Customer Agreement
Effective date: September 2, 2026
This Customer Agreement (the "Agreement") is a legal agreement between you (the "Customer" or "you") and SKJ APPS ("SKJ APPS", "we", "us" or "our"), the licensor and publisher of the DockApp software and any updates we make available under this Agreement (together, the "Software").
By installing, activating or using the Software, you agree to this Agreement. If you do not agree, do not install or use the Software.
If you obtained the Software through the Setapp Marketplace, please also read Section 3 below, which explains Setapp's role as merchant of record.
1. License Grant
The Software is licensed to you, not sold.
Subject to your compliance with this Agreement, SKJ APPS grants you a personal, limited, non-exclusive, non-transferable, non-sublicensable license to install and use the Software on the Mac computers that you own or control, for your personal or internal business use.
When you obtain the Software through Setapp, your right to install and use it is governed by your active Setapp subscription or your Setapp one-time purchase, together with the applicable Setapp terms, as further described in Section 3. When you obtain the Software directly from us, your license covers use on up to three (3) Macs that you own or control at one time, as a one-time purchase and not a subscription.
A license is intended for use by one individual and may not be shared among multiple users unless we or Setapp expressly offer, and you obtain, a multi-user or organizational license.
2. Ownership and Intellectual Property
The Software is protected by copyright and other intellectual-property laws and is provided under license.
SKJ APPS (and its licensors) retain all right, title and interest in and to the Software, including all intellectual-property rights. No ownership rights are transferred to you. No rights are granted to you except those expressly set out in this Agreement. The DockApp name and logo are trademarks of SKJ APPS.
3. Distribution Through Setapp (Merchant of Record)
When you obtain the Software through the Setapp Marketplace, operated by MacPaw Inc. and its affiliates ("Setapp"), you acknowledge and agree that:
- Setapp acts as the merchant of record for that transaction. Setapp is authorized by SKJ APPS to market, distribute, deliver and sublicense the Software to you on SKJ APPS' behalf, and to handle the related order, billing, payment, applicable taxes, invoicing and refunds.
- Your access to and use of the Software through Setapp is also subject to Setapp's own terms of service and policies. Setapp's role as an authorized distributor and reseller of the Software does not transfer any ownership of the Software to Setapp or to you.
- This Section is included to satisfy the requirements of the Setapp Developer Agreement (including its sections 5.d, 5.f and 5.g) regarding delivery and sublicensing of the Software to end users.
- Your right to use the Software obtained via Setapp continues for as long as permitted by your Setapp subscription or Setapp one-time purchase and the applicable Setapp terms. Questions about billing, your Setapp account or Setapp refunds should be directed to Setapp.
For the Software obtained directly from SKJ APPS (outside Setapp), our own storefront and payment provider act as merchant of record for that purchase.
4. Restrictions
Except to the extent applicable law expressly permits despite these restrictions, you may not:
- Copy the Software, other than for reasonable backup or archival purposes;
- Distribute, publish, resell, rent, lease, sublicense, lend, share or otherwise make the Software or your license available to any other person, except as expressly allowed through Setapp;
- Reverse engineer, decompile, disassemble or otherwise attempt to derive the source code of the Software;
- Modify, adapt, translate or create derivative works of the Software;
- Remove, alter or obscure any copyright, trademark, attribution or other proprietary notice;
- Circumvent, disable, tamper with or interfere with any license, security or entitlement mechanism; or
- Use the Software in violation of applicable law.
5. Updates and Future Versions
Your license includes updates that we choose to designate as updates to the version of the Software you obtained, when and if we make them available. Updates may include bug fixes, compatibility changes, security improvements and feature changes. We are not obligated to provide any particular update, feature, enhancement, maintenance or technical support.
Future major versions, separately branded products or optional paid features may require a separate purchase or a separate Setapp entitlement.
Changes to macOS, Apple technologies, hardware, third-party software or third-party services may affect the Software's compatibility, availability or functionality. We do not guarantee that the Software will remain compatible with every future operating system, hardware or third-party change.
6. Third-Party Software
The Software may include or use third-party software components governed by their own license terms. In particular, the Software includes the open-source Sparkle update framework, provided under its applicable open-source license. Nothing in this Agreement limits any rights granted to you under those third-party licenses. Applicable third-party notices may be provided with the Software or on our website.
7. Privacy
Your use of the Software is also subject to the DockApp Privacy Policy, available at https://dockapp.app/privacy , which explains what data the Software does and does not process and how any data is handled. When you obtain the Software through Setapp, Setapp processes your purchase and account information as an independent controller under its own privacy policy.
8. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY AND SYSTEM INTEGRATION. WE DO NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION OR ERROR, REMAIN COMPATIBLE WITH ANY PARTICULAR HARDWARE OR SOFTWARE, OR PREVENT DATA LOSS. YOU ARE RESPONSIBLE FOR MAINTAINING APPROPRIATE BACKUPS OF YOUR DATA.
Nothing in this Agreement excludes or limits any warranty or consumer protection that cannot lawfully be excluded or limited.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKJ APPS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, BUSINESS, GOODWILL OR USE, ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SOFTWARE OR THIS AGREEMENT WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE (OR, FOR ACCESS OBTAINED THROUGH SETAPP, THE AMOUNT ATTRIBUTABLE TO THE SOFTWARE UNDER YOUR SETAPP PLAN) IN THE TWELVE MONTHS BEFORE THE CLAIM.
Nothing in this Agreement excludes or limits liability that cannot lawfully be excluded or limited.
10. Termination
This Agreement remains effective until terminated. You may terminate it at any time by stopping all use of the Software and deleting all copies in your possession or control. Your license also ends if your Setapp entitlement to the Software ends.
We may terminate this Agreement or your license if you materially breach it and, where the breach can be corrected, you fail to correct it within a reasonable period after notice. We may also end access immediately in cases of unauthorized distribution or resale, license circumvention or tampering, fraudulent purchase activity, a refunded or charged-back purchase, or unlawful use of the Software.
On termination you must stop using the Software and delete all copies in your possession or control. Sections that by their nature should survive (including ownership, restrictions, disclaimers, limitation of liability and governing law) will survive termination.
11. Governing Law
This Agreement is governed by the laws of the State of Michigan, United States, without regard to its conflict-of-laws principles, except where the mandatory consumer-protection laws of your country of residence apply. Nothing in this Section deprives a consumer of any protection that cannot lawfully be waived under the laws applicable to that consumer. Where you obtained the Software through Setapp, the Setapp terms may separately govern the commercial and billing aspects of your transaction.
12. Changes to this Agreement
We may update this Agreement for future purchases or future versions of the Software. The version presented to you at the time you obtain or activate the Software will generally govern that transaction, unless a later change is required by law or you accept the updated Agreement. We will not retroactively remove material rights associated with a completed purchase without a valid legal basis.
13. Severability and Entire Agreement
If any provision of this Agreement is found invalid or unenforceable, it will be limited or severed to the minimum extent necessary and the remaining provisions will stay in full effect. This Agreement, together with the Privacy Policy, any applicable Setapp terms and any third-party license notices, is the entire agreement between you and SKJ APPS concerning the Software.
